ROCHESTER, N.Y. (WROC) — Congressman Joe Morelle announced plans to establish federal protections for In Vitro Fertilization on Friday.

Congressman Morelle is co-sponsoring the Access to Family Building Act which would establish a right for an individual to access assisted reproductive technology services like IVF, for example. This bill would also protect healthcare professionals who provide these services and allow the Department of Justice to take civil action against an entity that violates these protections.

Dr. Max Klein, a Reproductive Endocrinologist at Boston IVF’s fertility center in Syracuse said, “Protecting access to family-building medical treatment is imperative,” Dr. Klein continued, “It is estimated that approximately 1 in 6 individuals experience infertility in their lifetime, and our most advanced treatment of IVF accounts for up to 3% of births in the United States. As New York State is one of the few states with a fertility treatment coverage mandate, we as a community recognize the importance of access to family-building medical care. I as a medical professional stand proud to support this cause.”

The legislation would also create a private right of action for individuals and healthcare providers in states that have limited access to ART.
