Monroe County man sentenced to probation for workers’ compensation fraud

ROCHESTER, N.Y. (WROC) — A man from Monroe County who pleaded guilty to defrauding thousands of dollars from the NYS Workers’ Compensation System has been sentenced to probation.

According to the NYS Inspector General, 55-year-old Brian Simpson was sentenced in Webster Town Court Thursday to three years’ probation and was ordered to pay full restitution.

Between March 2022 and April 2023, the Inspector General said Simpson made misrepresentations to physicians and submitted incorrect paperwork to the NYS Insurance Fund, claiming he could not work because of a workplace injury.

Despite these claims, an investigation revealed Simpson was still working during this period as a bus driver for First Transit. Inc. and received over $16,000 in workers’ compensation benefits.

Simpson was charged with one count of offering a false instrument for filing in the second degree. He pleaded guilty on December 20, 2023.
